(back) Subject: Copyright protection of sampled sounds From: <DMillerRodgers@aol.com> Date: Thu, 10 Apr 2003 01:21:39 EDT   Dear List members,   The following is a response from Rodgers Instruments to the recent = discussion regarding copyrights and organ samples, and specifically addresses the = issue of sampling any of Rodgers' sounds.   ~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~ To PipeChat Readers:   In response to the recent discussion of copyright protection for sampled sounds, I would like to state the position of Rodgers Instruments:   It is clearly possible to protect sampled sounds contained in an = electronic instrument, including a Rodgers organ. Rodgers' parent company -- Roland = -- has obtained copyright registration for several sound sets created by = Roland, including the preeminent General MIDI sound set created for Roland's Sound =   Canvas, the "SC-55". The copyright registration is consistent with the = U.S. Copyright Act, 17 U.S.C. Section 101 which defines as protected "sound recordings," . . . a "series of musical, spoken, or other sounds . . . regardless of the nature of the material objects, such as disks, tapes or other phonorecords, in which they are embodied." Roland's sound = recordings fall within this definition. Rodgers and Roland have expended considerable =   investment and expertise in capturing and electronically processing = sounds. Rodgers has incorporated the Sound Canvas sounds into several of its products.   Any recording or sample of these sounds would constitute copyright infringement, for which Rodgers would be entitled to damages (including statutory damages of up to $150,000.00), as well as an injunction relief. =   Recently, Roland successfully sued and obtained injunctions against infringers in federal court in Los Angeles (Roland Corp U.S. v. Amtel Corporation, et. al -- Case no. 96-6455).   You may reasonably assume that Rodgers and Roland will actively seek to protect all copyrights.
